Defective/Dangerous Products
If a person is injured when a product is defective due to manufacture or construction, design or formulation, failure to warn, or is more dangerous than expected, the manufacturer of that product may be liable for damages. Successful defective product lawyers must be able to fully understand and develop all potential defective product claims. The lawyers at Weisman Kennedy have been successfully handling product liability claims resulting from defective medical devices, defective drugs and other more general defective consumer goods since the inception of the law firm.
Defective Medical Devices - Weisman Kennedy has an extensive history of resolving cases involving defective medical devices. For example, Weisman Kennedy represented over 700 clients in the In Re: Silicone Gel Breast Implant Litigation, MDL No. 926. Weisman Kennedy also represented multiple clients in the In Re Orthopedic Bone Screw Products Liability Litigation, MDL No. 1014.
Weisman Kennedy was also chosen to be a member of the Lead Counsel Committee in the In Re: Telectronics Pacing Systems, inc., Accufix Atrial "J" Leads Products Liability Litigation, MDL. No. 1057. Telectronics and its Australian parent were sued for the improper design of a heart pacemaker lead. In 1997, the firm acted as trial counsel in a summary jury trial that resulted in a verdict of $265 million against Telectronics. Thereafter, the firm was part of the negotiating team that settled the case on a national level for $95 million.
Weisman Kennedy also took the lead role in the In Re: Inter-op Hip Prosthesis Product Liability Litigation, MDL 1401, negotiating and overseeing the interests and rights of approximately 30,000 class members in the $1.1 Billion Settlement. Weisman Kennedy was intimately involved in every aspect of the litigation, from document discovery and depositions to settlement negotiations.
Dangerous and Defective Drugs - Weisman Kennedy has a deep history of handling dangerous and defective drug cases. For example, in the In Re: Showa Denko K.K. L-tryptophan Products Liability Litigation Action, MDL No. 865) Weisman Kennedy represented over 50 clients with multiple individual million dollar settlements. In the diet drug litigation, Weisman Kennedy represented dozens of individual cases and acted as sub-class counsel for the people who had sustained the most significant injuries in the $4.8 Billion diet drug settlement (In Re: Diet Drugs (Phentermine, Fenfluramine, Dexfenfluramine) Products Liability Litigation, MDL No. 1203).
Some other examples of successful defective product lawsuits handled by Weisman Kennedy include:
- $1.35 Million Settlement for injuries resulting from defective dump-truck. Our client was injured when the swing gate on a dump truck broke loose from the side of the truck due to a defective weld on the gate chain. The gate struck the front of our client’s head causing severe head trauma and a broken neck.
- $1 Million Verdict for death of 6 month old baby caused by defective crib. Six month old infant was strangled and died in his crib when his head became lodged between the mattress and the side rail. The defective crib design allowed the side rail to separate from the bed when a screw loosened and fell out.
- $480,000 Verdict for a rotator cuff injury that resulted from a basketball backboard falling. A basketball backboard fell while it was being raised. Weisman Kennedy was able to successfully show that the backboard fell due to a defective weld and ultimate weld failure.
